Family law - Financial agreements for overseas assets

How should overseas assets be dealt with in a family law financial agreement noting the different jurisdiction?

Thank you for the question.

The financial agreement can and should detail the arrangements for the assets in the overseas jurisdiction, but the issue will be whether it is binding and can be enforced in the overseas jurisdiction. Advice should be obtained from a family lawyer in the overseas jurisdiction as to the relevant laws and as to whether an agreement should also be entered into in that jurisdiction reflecting the terms of the Australian agreement.
