Asked

Conveyancing – Signing by making a mark

I act for a vendor in relation to the sale of a house and have received the contract from the purchaser's solicitor for exchange.

The purchaser has signed the contract by way of thumbprint. Is this sufficient execution to make the contract enforceable?

Answered

Thank you for the question.

Yes, a thumbprint is sufficient. Section 21 of the Interpretation Act 1987 defines sign to include making a mark.
