If property is held jointly and a party dies without severing the joint tenancy, then the fact
that proceedings are on foot would not be enough to prevent ownership passing to the
surviving party pursuant to the laws of survivorship.

If proceedings are on foot how does one "sever" joint tenancy to avoid this happening?

Can joint tenancy be "severed" during property negotiations where proceedings have not yet been filed by simply stating so in the course of correspondence?

Thank you for the question.

Where there are family law proceedings on foot then generally the severance of a joint tenancy isn’t required because upon the death of one of the parties, even if ownership transfers to the survivor, the family law proceedings continue under s79(8) and injunctive relief can be sought to prevent dealing with the property.
