Asked

Superannuation – Corporate trustee directors and shareholders

I know the members of a superannuation fund have to be the directors of the corporate trustee. Do they also have to be shareholders?

Answered

Thank you for the question.

There is no requirement for a member of a self managed superannuation fund to be a shareholder of the trustee company: see s 17A of the Superannuation Industry (Supervision) Act 1993.

However, it is usual for the members to be the directors and shareholders.
