Out of the box!

Litigation
Victoria

Asked

Hi

Background:
Client sold packaging materials to purchaser who onsold them to a third party. Purchaser refused to pay client and alleged that third party refused to accept the goods as they are not fit for purpose.

Question:
Can such matter be litigated in the VCAT Civil Claims List as an alternative to the Magistrates' Court?

Thank you.

Answered

Thank you for the question.

The Civil Claims Lists is the proper list for dealing with disputes that arise out of the purchase or supply of any goods or services of any value by any persons or businesses, including companies against each other, for any amount of money that arises in connection to the State of Victoria. VCAT can also deal with disputes under the Australian Consumer Law for misleading conduct, unconscionable conduct, and consumer guarantees.
